1. Acceptance of Terms

By accessing or using the NightOps Logistics platform ("Service"), operated by BDM Digital Enterprises LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

NightOps provides an AI-powered logistics management platform including route optimization, automated dispatching, fleet tracking, and operational analytics. Features may change as the platform evolves.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information when creating an account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse-engineer or attempt to extract the source code
  • Use the Service to transmit malicious code or harmful content

5. Intellectual Property

The Service, including all software, AI models, designs, and content, is the property of BDM Digital Enterprises LLC and is protected by intellectual property laws. Your data remains yours — we claim no ownership over logistics data you input into the platform.

6. Limitation of Liability

To the maximum extent permitted by law, NightOps shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice when possible.

8. Termination

Either party may terminate the agreement at any time. Upon termination, your right to use the Service ceases. We will provide a reasonable period to export your data.

9. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
